Terms and Conditions

This document outlines the terms and conditions of the services to be provided by Costa Blanca Business Solutions. Acceptance of any proposal and payment of the initial deposit constitutes agreement to these terms.

1. Scope of Services The services provided are limited to the scope of work detailed in the main body of this proposal. Any additional services requested outside of this scope will be considered a "change request" and may require a separate proposal and additional fees.

2. Payment Terms

  • An initial, non-refundable deposit of 50% of the total quoted fee is required to schedule and commence the project.

  • The remaining 50% balance is due immediately upon project completion, prior to the handover of any final administrator credentials.

  • Payments are to be made via bank transfer to the account specified on the invoice.

3. Cancellation Policy

  • The initial 50% deposit is non-refundable and serves to secure your project slot and cover initial discovery and planning work.

  • Should the client choose to cancel the project for any reason after work has commenced, the initial 50% deposit will be retained by Costa Blanca Business Solutions to cover work already performed.

4. Client Responsibilities To ensure a timely and successful project, the client agrees to:

  • Provide all necessary access to existing systems, domain registrar, and other required credentials in a timely manner.

  • Appoint a single point of contact who is authorised to make decisions on behalf of the company.

  • Verify Data Migration: Upon notification that the data migration is complete, the client is responsible for reviewing and verifying that their data (emails, contacts, files, etc.) has been successfully migrated to their satisfaction. The project cannot be deemed complete until this verification has been made.

5. Confidentiality Confidentiality is a cornerstone of our business. Costa Blanca Business Solutions will treat all client information, data, and credentials with the strictest confidence. We will not disclose any sensitive information to any third party without the client's express written consent, unless required by law.

6. Third-Party Costs This proposal covers the professional services provided by Costa Blanca Business Solutions only. The ongoing subscription fees for software itself (e.g., Microsoft 365 or Google Workspace) are separate and are to be paid directly by the client to the provider. We will guide you through the subscription process.

7. Project Completion Project completion is defined as the successful migration of data as per the agreed scope and the delivery of the scheduled team training sessions. Timelines provided are estimates and may be affected by delays in receiving necessary information or access from the client.

8. Post-Project Support This agreement covers the services detailed in the proposal. Any support required after the formal project completion and handover will be considered a new engagement. Ongoing tech support is available via a separate retainer-based or flexible support agreement.

9. Limitation of Liability Costa Blanca Business Solutions will perform all services with professional skill and care. However, we cannot be held liable for any data loss that occurs from the client's existing systems prior to migration, or for issues arising from third-party software providers (Microsoft, Google, etc.). Our total liability for any claim arising from this agreement is limited to the total fee paid for the services.

10. Governing Law This agreement shall be governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alicante.

11. Data Protection In the performance of these services, Costa Blanca Business Solutions acts as a 'Data Processor' on behalf of the client. We will only access and process client data as necessary to fulfil the services outlined in this agreement and upon the client's instruction. We commit to maintaining the confidentiality and security of this data in accordance with the prevailing data protection regulations (LOPDGDD and GDPR).

12. Pre-existing Conditions The client is responsible for ensuring that their existing hardware, office network, and internet connectivity are functional and meet the minimum requirements for the new platform. The services covered in this proposal do not include the diagnosis or repair of pre-existing issues with the client's IT infrastructure unless explicitly stated.

13. On-Site Services This proposal includes [e.g., one on-site training session] at the client's primary office located within the Javea area. Any additional on-site visits requested by the client, or visits to locations outside of Javea, may be subject to additional fees to cover travel time and expenses.
